Terms of Service

By accessing or using dataline.xyz and any related services, applications, or content (collectively, the "Service") operated by Dataline ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

Accounts

You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact address below of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

  • Violate any applicable law, regulation, or third-party right;
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems or networks;
  • Interfere with or disrupt the integrity or performance of the Service, including through viruses, malware, scraping, or automated access without our prior written consent;
  • Reverse engineer, decompile, or disassemble any part of the Service except as permitted by law;
  • Use the Service to transmit content that is unlawful, infringing, defamatory, or harmful;
  • Resell, sublicense, or commercially exploit the Service without our prior written consent.

We may suspend or terminate your access at any time for violation of these Terms.

User Content

You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate and improve the Service. You represent that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.

The Service and all associated content, features, software, trademarks, and branding (excluding User Content) are owned by Dataline or its licensors and are protected by intellectual property laws. No rights are granted to you other than the limited right to use the Service as permitted by these Terms.

Third-Party Services

The Service may contain links to or integrations with third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Fees and Payment

If any portion of the Service requires payment, pricing and billing terms will be presented at the point of purchase. Except as required by law, all fees are non-refundable. We may change pricing with reasonable prior notice; continued use after a price change constitutes acceptance.

Our collection and use of personal information is described in our Privacy Policy, available at dataline.xyz/privacy. By using the Service, you consent to that collection and use.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT OR DATA PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR RELIABLE. NOTHING PROVIDED THROUGH THE SERVICE CONSTITUTES PROFESSIONAL, FINANCIAL, LEGAL, OR TAX ADVICE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATALINE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to indemnify and hold harmless Dataline and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

Termination

We may suspend or terminate the Service or your access to it at any time, with or without cause or notice. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 5, 6, 10, 11, 12, and 15) will survive.

Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on this page with a revised effective date, and where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. YOU AND DATALINE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Miscellaneous

These Terms constitute the entire agreement between you and Dataline regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them without restriction.
